1. Acceptance of Terms

Welcome to Dabbewaala, operated by AumAI Technologies ("we", "us", or "our"). By accessing or using the Dabbewaala mobile application, website, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

2. Description of Services

Dabbewaala is a technology platform that connects customers with home-based kitchen partners ("Kitchen Partners") who prepare homemade food. We facilitate the ordering, payment, and delivery of food items through our Platform. Key aspects of our service include:

  • Marketplace: We provide a platform for Kitchen Partners to list their menus and for customers to browse, select, and order food items.
  • Delivery: We coordinate the delivery of orders through our network of delivery partners.
  • Payments: We facilitate secure payment processing through third-party payment providers.

We act as an intermediary between customers and Kitchen Partners. We do not prepare food ourselves and are not responsible for the quality, safety, or legality of food prepared by Kitchen Partners, except to the extent required by applicable law.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your login credentials confidential and not share them with others.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate your account at our sole discretion if we suspect any violation of these Terms, fraudulent activity, or misuse of the Platform.

4. Orders and Payments

a) Placing Orders

  • All orders placed through the Platform constitute an offer to purchase food items from Kitchen Partners.
  • Orders are confirmed only after successful payment processing. An order confirmation will be sent to you via the app.
  • Availability of menu items is subject to the Kitchen Partner's capacity and may change without prior notice.

b) Pricing

  • Prices are set by Kitchen Partners and displayed on the Platform inclusive of applicable taxes unless stated otherwise.
  • Delivery charges, platform fees, and other applicable charges will be clearly displayed before you confirm your order.
  • We reserve the right to modify pricing structure and fees at any time.

c) Payments

  • Payments are processed securely through Razorpay. By making a payment, you agree to Razorpay's terms of service.
  • We accept various payment methods including UPI, credit cards, debit cards, net banking, and digital wallets.
  • You are responsible for any fees charged by your bank or payment provider.

5. Delivery

  • Delivery times are estimates and may vary depending on order volume, kitchen preparation time, weather conditions, traffic, and other factors.
  • You must provide an accurate and complete delivery address. We are not responsible for failed deliveries due to incorrect address information.
  • You or an authorised recipient must be available at the delivery address to receive the order. If no one is available, the delivery partner will attempt to contact you. Failure to receive the order may result in the order being marked as undelivered.
  • Risk of loss and title for items pass to you upon delivery.

6. Cancellation and Refunds

a) Cancellation by Customer

  • You may cancel an order before the Kitchen Partner begins preparation. Cancellation eligibility and any applicable charges are determined based on the order status at the time of cancellation.
  • Orders that have already been prepared or picked up cannot be cancelled.

b) Cancellation by Kitchen Partner or Dabbewaala

  • Kitchen Partners may cancel orders due to ingredient unavailability, capacity constraints, or other operational reasons.
  • We may cancel orders if we detect suspicious activity, payment issues, or violations of these Terms.
  • In such cases, a full refund will be processed to your original payment method.

c) Refunds

Refunds are subject to our Refund Policy. Please refer to our Refund Policy for detailed information on refund eligibility, process, and timelines.

7. User Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the Platform or servers connected to the Platform.
  • Attempt to gain unauthorised access to any part of the Platform.
  • Use automated means (bots, scrapers, etc.) to access the Platform without our permission.
  • Harass, abuse, or threaten Kitchen Partners, delivery partners, or other users.
  • Post false reviews, ratings, or misleading information.
  • Misuse promotions, referral programmes, or discount codes.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and the arrangement thereof, is the property of AumAI Technologies or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability for any claims related to the Platform shall not exceed the amount you paid for the specific order giving rise to the claim.
  • We are not liable for the quality, safety, or legality of food prepared by Kitchen Partners.

10. Indemnification

You agree to indemnify, defend, and hold harmless AumAI Technologies, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

In the event of any dispute, the parties shall first attempt to resolve the matter amicably through good faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue legal remedies as permitted under applicable law.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
